Mental Health is also something we will talk about in this topic and why it’s necessary for all defendants to understand their rights especially if they have some mental illness.   Ã‚  Ã‚   Mental Health In some cases an individual is considered an imminent danger to themselves or others, they have the right to due process, representation and appeals just like anyone else, though appeals can be civil commitment or involuntary treatment.   Ã‚  Ã‚   Jackson v. Indiana was known as a â€Å"landmark† case only because The United States had violated due processing for Jackson who was committed for a indefinite period of time. Then he was also, a deaf-mute in which he was not able to read or write. In which, he was going to need a lawyer and needed to take the competency evaluation to see if he was fit to stand trial. â€Å"An individual found incompetent will nevertheless be detained for a ‘reasonable period of time necessary to determine whether there is a substantial probability that he will attain that capacity in the foreseeable future.’† (Supreme Court pg 17). This quote here is basically telling us that since Jackson had a mental illness and not capable of standing trial. So there for he was put into a â€Å"Indiana Department of Mental Health for treatment until he was determined to be ‘sane.’† (Jackson v. Indiana). But, his lawyer wanted to have a new trial because there was no evidence that his client was insane and that he was getting a life sentence in a mental hospital without being convicted of a crime. But, the motion was denied by the Supreme Court of Indiana. The Court therefore said that since Jackson wasn’t considered mentally ill according to their standards then he would be able to be released at any time. The Court also said that â€Å"[a] person charged by a State with a criminal offense who is committed solely on account of his incapacity to proceed to trial cannot be held more than the reasonable period of time necessary to determine whether there is a substantial probability that he will attain that capacity in the foreseeable future. If it is determined that this is not the case, then the State must either institute the customary civil commitment proceeding that would be required to commit indefinitely any other citizen, or release the defendant. Furthermore, even if it is determined that the defendant probably soon will be able to stand trial, his continued commitment must be justified by progress toward that goal.† (Jackson v. Indiana). They finally decided that holding people for an indefinite period of time was unjust. But, it was too late for that since Theon Jackson was already held for an indefinite period of time without getting another trial. It was only because there was a lack of due process that’s why the Court concluded with this statement. The Court decision to put Jackson in a mental institution without being committed of a crime or being put in there because he was unable to comprehend why he was being arrested. Therefore, the Justices were not fair or just towards Mr. Jackson having him spend years in a mental institution because he was a dead-mute person who couldn’t read or write with a low I.Q Kansas v. Hendricks case was one that used the Kansas’ Sexually Violent Predator Act. In which, states the procedure for civil commitment of a person due to a â€Å"mental illness†. Hendricks was sent to jail because he sexually molested children at different period of times. After, he was then released after serving ten years of his sentencing. He was clinically diagnosed as a pedophile and believed that he couldn’t be successfully treated. Pedophilia is defined as a mental abnormality under the Act, so they ordered that Hendricks be civilly committed. In the case of Hendricks trial the jury found him to be a sexual violent predator and he then appealed their claim. The Kansas Supreme Court held the Act unconstitutional. The Kansas Sexually Violent Predator Act is penalized when a person is sentenced and tried as a predator and allows his release. But, when the offender is charged and sentenced for life in prison then the Act is unnecessary.   But, some have argued that â€Å"the statue is really a further criminal penalty disguised as a civil commitment† (Kansas v. Hendricks pg 2). The actions of the Court were brilliant and fast because he needed to be put away for sexually abusing children and shouldn’t be set free from prison but, also putting him in a mental institution was also a good option. But, it feels as though that the Court might have done double jeopardy in which they did put him in the mental institution for committing the same crime he was charged for. Double jeopardy clearly states the prosecution of a person twice for the same offense in which, Mr. Hendricks had been in.

The Evergreen Marching Band and Colorguard (EMBC) has stewed in accomplishment, success, and hard work, for more than two decades. People don’t know, that we re not just a normal halftime marching band--we are a competitive marching band. Like any football, drill, or soccer team, EMBC strives to compete amongst the greats. For a couple decades, EMBC has marched to success and we don t want to stop now; however, the competitive program was close to being slashed this year, due to lack of funds. Students and parents raged at the thought of no competitive season. Competing is the best part for everyone in this program. If we lost that it wouldn’t be as much fun. We were so far in debt that if we couldn t raise enough money, it would ve been game over. If we had more money in our budget to do our competitive season, we would not have to say goodbye to competing. The program receives a mere $1000, for the whole band program, as said by the band director. That is not enough for our program. My school district needs to fund the EMBC program separately from the regular band programs. I am not saying that their program isn’t as important, but we, the EMBC, require more funding for our award winning program. It is a sport, and therefore merits the full funding like any other team. But this line altogether shows how Richard is in such a weak state that he goes through the trouble to not only comfort himself, but also to remind himself not to gloat. In the next section (194-200), Richard moves on from arguing with his conscience, to thinking about the crimes he has committed. The section starts with a metaphor comparing his conscience with a creature with several tongues showing that there are many different voices in Richard’s conscience. This line ties in with the next two lines smoothly with the help of (an-uh-dip-lo-sis). The word â€Å"tongue† is brought up again in the beginning of the next line which is followed by reiterating the word â€Å"tale† from the end of the last line. Interview with a Record Store Owner Essay On a less then pleasant day the weather was cold and rainy so before I left the safety of my car I turned my collar up to face the cold and made a bee line to the store so fast it would put Usain Bolt to shame. When I walked in the store I was greeted by the smell of coffee and sound of The Rolling Stones song Monkey Man playing over the store speakers with the owner of the store john singing along to the song and throwing his arms up like a monkey. As soon as you walk into the store your face to face with a giant rack of used DVDs ranging from Driving Miss Daisy to the Texas Chainsaw Massacre the store itself is not very big on the left side of the store is a shelf contain records from Abba to Rob Zombie on the right side is a shelf holding the cds. I was immediately welcomed by john who sitting down in behind his cash register with a sign on it that read â€Å"No Personal Check† behind him was a giant poster of Frank Zappa which seemed like one of his most prized positions john had. John had on a tie dyed rolling stones shirt john had looked tried and he seemed to be discomfort later I found out he looked that way due to having MS. Before john and I stared talking I asked if we could take a walk around the store john told me that he is not able to â€Å"move very well because I have Multiple sclerosis† so he called for his employee Jack to walk with me and directed Jack to answer questions I have. Jack was tall and in his early 20s ,jack and I walked around the store looking at vinyl they had they had seemed to have every record you could ask for and if they didn’t have it they could order it for you . I asked jack to explain the process of how they value the used records that come in the shop jack pulled a random of the shelf and proceeded to go over the check list â€Å"first we look at the condition of the album sleeve any bends or damage to it second we look for the labeling mono, monophonic, monaural, stereo or stereophonic on the sleeve and record label, which identifies the recording process and helps us determine the value and finally we Evaluate the condition of the record by looking for any obvious damage to the vinyl. Jack holds the record up to the light on a slight tilt Look for scratches, record edge nicks or damage to the paper label† we have music here for everyone’s price range after that I thanked jack and retuned to talk to john. When I came back to talk to john he had offered me a cup of coffee I accepted and went on to ask john how long has the store been open john told me that â€Å"I am the fifth owner of Rainbow Records; it first started out in Park Ridge in the mid-1970s. Then the store was moved to Palatine in 1993 by the fourth owner, who offered me the opportunity to buy the store from him in 1997 I then eventually moved the store to here†. I asked john what was the first record he had ever purchased john though for a minute and said â€Å"Surfin Safari by The Beach Boys when I was 9-years-old† I ask john why do you think vinyl sales are going up while CD sales are falling â€Å"There is nothing like vinyl It has a totally different sound than CDs or that MP3 stuff. I’m sorry, but you don’t listen to music on a phone and really get to appreciate it.† I said to john it looks like your store buys all types of records and CDs is there any type of music you won’t buy? â€Å"Classical no one asks for it so I don’t want it besides this is a rock and roll store† John what do you think about kids that have never heard a record on vinyl? They are really missing out Vinyl has a great in-depth sound to it,† he says. â€Å"There is an art to what I call albums and what everybody called albums back in the day. From the cover, which is a piece of art in itself, to listening to, and appreciating the way songs are arranged from side to side, you don’t get that with any other music format.† Looking around the store and seeing I was the only person in there besides jack maybe because of the weather but maybe because the store isn’t doing so well I asked john what got him into the record business â€Å"If you think about how much money you’re going to make, that’s a mistake. You’re not going to get rich doing this. What you’re doing is sharing your love of music with other people,† after john told me that a smile came across both of are faces. Before I had left the shop I walked around the store and picked up three records I think john would approve of the first one I got was The Rolling Stones Let It Bleed, Second album I grabbed was Surfin Safari by The Beach Boys and the third one was Frank Zappa Over-Nite Sensation. When I went up to john for the last time he could not help but to laugh as he rang them up as he handed me the bright yellow bag he said â€Å"enjoy† when I had made it home the first thing I did was put on my new rolling stones record put the needle on Monkey Man and turned my record player up to eleven.

Adolescent pregnancy is a crisis that inadvertently affects all. This is not only a burden to the young woman and her family, but also has a consequential impact on society. By reducing the number of adolescent pregnancies we could promote child well-being and decrease child poverty statistics (National Data). Increasing the number of comprehensive sex education courses would help young people learn how to better protect themselves against premature pregnancy and STDs, and would in turn curtail the number of teenage pregnancies. Among industrialized countries the United States has the highest rates of adolescent pregnancy. The rate of teen pregnancy in the U.S. is twice that of Great Britain and four times that of Germany and France. According to Saul Hoffman, Ph.D. and publisher of the National Campaign to Prevent Teen Pregnancy study, adolescent childbearing in 2011 alone cost U.S. taxpayers $10.1 billion, (Hoffman 2012.) Statistics show the alarming number of female adolescents walking around with oversized stomachs. Three in ten girls in the United States get pregnant at least once by age twenty (National Data). Less than one three of teen mothers obtain a high school diploma and only 1.5 percent have a college degree. Adolescent mothers are at a greater risk for birthing complications such as pregnancy induced hypertension, poor weight gain throughout pregnancy, and pregnancy-induced hypertension (Hoffman 2012). Infants born to adolescent mothers have a greater risk for premature birth, low birth rate, increasing the possibility of infant death, mental retardation, and chronic respiratory problems.
